introduction

welcome to scalefit. these terms of service (the "terms") govern your access to and use of the scalefit platform, including our web application, mobile applications, and related services (collectively, the "service"). scalefit is operated by scalefit lda., a company registered in portugal.

by creating an account or otherwise using the service, you agree to be bound by these terms. if you are using the service on behalf of an organization, you represent that you have authority to bind that organization. if you do not agree, please do not use the service.

we may revise these terms from time to time. material changes will be notified at least 30 days in advance via email or in-app message. continued use after the effective date constitutes acceptance.

acceptable use

scalefit exists to help athletes train smarter and coaches scale their practice. you agree to use the service only for its intended purpose and in compliance with all applicable laws.

you specifically agree not to:

  • upload content that is unlawful, harassing, defamatory, or infringing on the rights of others
  • attempt to gain unauthorized access to any part of the service, other accounts, or connected systems
  • submit fraudulent check-in data, manipulated progress photos, or fabricated metrics
  • use automated tools (scrapers, bots, crawlers) to access the service without prior written permission
  • reverse engineer, decompile, or attempt to derive source code from the service
  • resell, sublicense, or otherwise commercialize the service without an enterprise agreement
  • interfere with the integrity or performance of the service or its underlying infrastructure

we reserve the right to investigate suspected violations and to suspend or terminate accounts that engage in prohibited conduct.

user accounts

to use most features of scalefit you must register for an account. you must be at least 16 years of age, or the minimum age required to consent to data processing in your jurisdiction. accounts for minors aged 13 to 15 require verifiable parental consent and may have restricted functionality.

when you register, you agree to:

  • provide accurate, current, and complete information
  • keep your password confidential and not share account credentials
  • notify us promptly at security@scalefit.app of any unauthorized access
  • accept responsibility for all activity that occurs under your account

coach and brand accounts may have additional verification requirements, including proof of qualifications and identity. we may suspend coach accounts pending verification.

payments & subscriptions

scalefit offers tiered subscription plans for athletes and coaches. prices, billing cycles, and included features are presented at checkout. by purchasing a subscription, you authorize recurring charges to your chosen payment method until you cancel.

payments are processed by stripe payments europe, ltd. scalefit does not store full card numbers. all transactions are protected by pci-dss certified infrastructure.

subscriptions renew automatically at the end of each billing period. you may cancel at any time from your account settings; cancellation takes effect at the end of the current paid period. eu consumers have a 14-day right of withdrawal for initial subscription purchases, except where the service has been fully performed during that period at your explicit request.

challenge entry fees and one-time purchases are generally non-refundable once the challenge has started or the content has been delivered.

termination

you may terminate your account at any time by selecting "delete account" in settings or by emailing support@scalefit.app. upon termination, your right to use the service ends immediately and your data will be deleted in accordance with our privacy policy.

we may suspend or terminate your account if we reasonably believe you have violated these terms, if required by law, or if your account remains inactive for more than 24 months. we will give you reasonable advance notice unless doing so would cause harm to other users or to the service.

active subscriptions are honored for the remainder of the current paid period. refunds for material service failures will be considered on a case-by-case basis.
